Hr on (mock) trial: disability & retaliation: would you make the same decisions?

It’s every HR practitioner’s worst nightmare: a day in court. In this exciting, interactive session, you will experience first-hand what happens when employees file a lawsuit. If you have ever wondered what it would be like to go to trial, this is a safe, entertaining, and informative way to do it.  See the types of questions you, as an HR leader, would face on the stand.  Ponder how well your decisions would hold up.  This “mock” trial is pretty realistic with actual plaintiff and employer attorneys battling for the jury’s favor.  


Dana Sullivan represents employees at her firm Buchanan, Angeli, Altschul, and Sullivan, LLP.  She’ll terrify you with her cross examination, and make you question some of things your organization may be doing.  Dana has be victorious in many nationally recognized discrimination cases and did investigation work for the EEOC in Washington DC.

 

Jennifer Nelson represents public and private employers with her firm, Ogletree Deakins and also has plenty of litigation experience in Oregon and Washington courtrooms, Federal Court, and in front of the EEOC.  An accomplished writer and presenter, she recently published articles for SHRM on the Oregon Pay Equity Act and HR burnout.

About the attorneys:

Dana Sullivan - Dana Sullivan is one of the most highly-regarded lawyers in Oregon representing individuals in employment and civil rights litigation.  She regularly tries discrimination cases in both federal and state court and also devotes a significant part of her practice to advising executives in the negotiation of employment contracts or separation agreements.  Dana has been selected for inclusion in Best Lawyers, and Super Lawyers has listed her among the top 25 women lawyers in Oregon and among Oregon’s top 50 lawyers.  Dana is a past president of both the Oregon Trial Lawyers Association and the Multnomah Bar Association.

Dana earned her Bachelor of Arts degree, magna cum laude, from Princeton University and went on to earn a law degree at New York University School of Law. Dana’s many volunteer activities include service on the Legal Committee of Legal Voice, a Seattle-based organization devoted to advancing the rights of women, and Dana also serves on the Board of Governors of Girls Inc. of Northwest Oregon. Dana is a frequent speaker at continuing legal education programs and has served as a guest lecturer for classes at Portland State University and Lewis & Clark Law School.  Recent topics include family leave and disability laws, sexual harassment claims, the basics of litigating an employment case, proving damages, and issues surrounding expert witness testimony.

Jennifer Nelson - Jennifer Nelson is a shareholder in one of the oldest and largest national employment law firms, exclusively representing employers in all facets of labor and employment law, including single plaintiff and class action litigation, policy writing, handbooks, non-compete/non-solicitation agreements, negotiations, and daily advice regarding all facets of the employer/employee relationship. She represents public and private employers in all aspects of employment law, including several class action claims, involving:

  • discrimination;
  • harassment;
  • wrongful termination;
  • retaliation;
  • reasonable accommodation;
  • non-competition/non-solicitation; and
  • wage and hour issues.

She has successfully represented employers in Oregon and Washington in state and federal courts, as well as before the Equal Employment Opportunity Commission, the Oregon Bureau of Labor and Industries, and the Washington Human Rights Commission.

Jennifer also counsels both large and small companies on a variety of employment issues, including:

  • employee discipline and termination;
  • wage and hour compliance;
  • policy drafting;
  • reasonable accommodation; and
  • adherence to federal and state family and medical leave laws.

Additionally, she has spoken at several employment law seminars and provides management, human resources and employee training.
